In a recent decision handed down by the High Court on a 4-3 majority, it was determined that Victoria's State based tax under the ZLEV Charge Act 2021 (Zero and Low Emission Vehicles), was invalid under the Constitution as it was classed as an excise not a tax. And only the Commonwealth and not the states can impose an excise under s90 of the Constitution. Has this opened the floodgates to raise questions as to the efficacy of State and Territory based laws which seek to impose taxes, like payrol tax? This decision has certainly started the conversation and may give every payroll taxpayer the opportunity to consider contesting the validity of payroll tax.
