Will this finally be a game changer for off the plan contracts in Qld? I think so. On 19 April 2023, our Attorney General, Shannon Fentiman has finally announced proposed new laws to change how the sunset date works in Qld for off the plan contracts: https://statements.qld.gov.au/statements/97588 We have yet to see the proposed legislation but it may end up mirroring the NSW sunset date provisions where developers cannot terminate an off the plan contract without buyer consent or a Supreme Court order. This has become a highly controversial issue in Qld with developers terminating off the plan contracts following the sunset date expiration, to then resell at a higher price. The latest project that has hit the headlines where a developer has purportedly terminated an off the plan contract to then resell at a higher price, almost immediately, the Parkside Residences project at Rochedale, https://www.news.com.au/finance/real-estate/buying/qld-couples-250k-home-nightmare-after-developer-activates-legal-sunset-clause/news-story/aecaabf1e6e2bbd0cf304b5711400acc where the buyer is reported to have said: "For me I want to warn the people that if they try to purchase an off-the-plan property in Queensland this is what they can do".
