There is a current loophole in the Qld legislation concerning deposits in off the plan contracts, where deposits can in fact be released early to a developer, it will depend on the terms of that off the plan contract, that should always be checked before you sign. There are a myriad of reasons why you should always, always get an off the plan contract reviewed, and proper legal advice given, by a lawyer who actually practices in this area on a constant and regular basis.
