In this episode we do our best to answer Mike's question who is a regular listener to our show. We discuss generally what may be considered acceptable steps or conduct under the Qld Criminal Code that a homeowner can take if a home invasion occurs and what to do if confronted. Over the Christmas break in Brisbane and the Gold Coast we saw a spate of burglaries and home invasions. As a homeowner what rights do you have, what is considered acceptable force, and are you entitled to use weapons or take other steps you consider reasonable and necessary. What is considered "reasonably necessary" depends on the facts and circumstances, the person's perception at the time of what was occuring, whether the conduct was wilful or unwilful, provoked or unprovoked, and whether that person was fearing for their own safety and/or the safety of others at the time. Self-defence is available under the Qld Criminal Code but is not a given. It does depend. Take a listen! If you find yourself in this situation please obtain advice from a criminal lawyer.

The show was designed to give back to the community which Despina did in droves.
