In this segment, I get to talk about the fundamentals of our democractic society and the hallmarks of trials by jury, and the challenges we continue to face in our society led by social media. It is becoming increasingly more difficult to maintain the 'jury bubble' concept to ensure impartiality and objectivity in jury trials. Should we not be moving towards trials by judge, for certain cases that become high profile, and where certain parameters are met, for example, the nature of the case (eg allegations of sexual assault, rape, DV, murder), the parties involved (e.g. politicians, sports people, celebrities, other high profile people), and where the hype of social media attention has passed a certain threshold. But what does that threshold look like? An interesting discussion on all of these aspects, only 9 minutes, take a listen.
