A new era of selling property in Qld will soon be upon us!!!

It will be a significant departure from the past for owners of property wanting to sell and new processes and rules will be implemented.
Being a member of the Qld Law Society's Property and Development Law Committee, I understand at the coalface the practicalities of the new regime that will commence. Priala Legal will be well positioned to work with all owners of property and selling agents to best assist them moving forward.
A few law firms have already promoted their new costs that will apply to this new regime. We believe this is premature as external service providers are still yet to provide their own new costings for the new searches that must be obtained. We will be announcing a new process and fee structure following 1 July when all relevant search costings will be properly disclosed by relevant providers.
In the lead up to Friday 1 August, the biggest issue will be for agents to come up with a plan for the signing of contracts. Noting the new regime means:
1. A new contract cannot be entered into by the buyer without being given the new seller disclosure statement first with the prescribed certificates and searches completed; and
2. The new seller disclosure statement cannot actually be used until 1 August; and
3. Sellers will need evidence the buyer has actually received the seller disclosure statement before a contract of sale is given. This will prove interesting when it is not a requirement under the new legislation for a buyer to actually sign the disclosure statement.
Thus, agents and sellers will need to be mindful of their practices in the days leading up to 1 August and if both parties have not yet signed a contract by 31 July, it may need to be postponed with the new regime kicking in until 1 August.
