In Qld it is buyer beware when buying property. But when buying a duplex, many buyers are of the misunderstanding that no issues can arise and it is like buying a house. It is anything but. Recently, we had cause to advise a buyer who was represented by someone else, as to how a sewer line that ran through their exclusive use area yard, did not have to be disclosed to them and why there was really no cause of action. This buyer did not receive any advice upfront, was not provided with any searches upfront as they should have been, and 5 days leading up to settlement discovered this substantial infrastructure which meant that area could not be built over for a deck, pool or other structure. You get what you pay for when you skimp out on appointing an experienced professional property lawyer who knows what to look for early on and what to advise you on. It is just too risky otherwise.
