In a Canadian Superior Court it was recently determined that a thumbs-up emoji constituted acceptance of a contract and binding on the parties, determining that the court, "could not and should not attempt to stem the tide of technology". Would this be applied here in Australia? In our Episode 29 we discussed a first emoji case in Australia: https://www.youtube.com/watch?v=JvA0Xh7yoUQ&t=0s Each case will always turn on its own facts, this was quite an unusual situation and may very well open the floodgates for more cases where emoji's are considered acceptable forms of communication in transactions and contracts. However, it always depends on the facts of the case. In this particular case the court referred to the prior communications between the parties which formed the basis for the determination. The message? Be careful how you use those emoji's in communications. Not sure what an emoji may mean? The court referenced the tool emoji by dictionary.com as a matter of interest. There is potential for the above case to be duplicated in Australia.
